This Privacy Policy ("Privacy Policy" or "Policy") explains how ChatsPub Ventures (OPC) Private Limited ("Company", "FanChat" and or “Fanchat Creators” "we", "our", or "us") collects, receives, stores, processes, uses, shares, retains, secures, and deletes personal information when you access or use the FanChat mobile application, website, APIs, customer support, communication services, and related digital services (collectively, the "Platform").

The Company values your privacy and is committed to protecting your personal data through responsible processing practices, commercially reasonable security measures, and compliance with applicable laws.

This Privacy Policy forms an integral part of the Terms of Use governing FanChat.

By downloading, installing, registering, accessing, or using the Platform, you acknowledge that you have read, understood, and agreed to this Privacy Policy.

If you do not agree with this Privacy Policy, you should discontinue use of the Platform.

This document is a consolidated compilation of the Privacy Policy Parts 1–4 supplied by you. Drafting commentary, “coming next” material, and the recommendation to move to another policy have been removed from the operative document; the substantive privacy provisions have been retained and organized as one policy. Before publication, qualified Indian counsel should review the final policy against FanChat’s actual data flows, consent mechanisms, recording practices, children/minor access, payment systems, third-party processors, retention schedules, grievance process, and applicable law.

This Policy applies to all information collected through FanChat mobile applications; official websites; customer support channels; email communications; verification procedures; payment and wallet services; promotional campaigns; surveys; and social media pages operated by the Company.
3. DEFINITIONS
For the purposes of this Policy:
Personal Data means any information that identifies or can reasonably identify an individual, directly or indirectly.
Sensitive Personal Data means categories of information requiring enhanced protection under applicable law or Company policy, including identity verification records, financial details, audio and video call recordings, and other information treated as sensitive.
Processing includes collecting, recording, organizing, storing, adapting, retrieving, using, sharing, transmitting, securing, retaining, deleting, anonymizing, or otherwise handling Personal Data.
User means any person who accesses or uses FanChat.
Creator means a User approved by the Company to offer creator services or monetize content through the Platform.
Fan means a User who interacts with Creators or uses other features available on the Platform.
4. APPLICABLE LEGAL FRAMEWORK
The Company intends to operate its privacy program in accordance with applicable laws, including, where relevant:
• the Digital Personal Data Protection Act, 2023;
• the Information Technology Act, 2000;
• applicable rules issued thereunder;
• lawful directions of courts and competent authorities;
• applicable consumer protection requirements;
• payment-related legal obligations; and
• applicable platform requirements published by mobile application marketplaces.
Nothing in this Privacy Policy shall limit any rights that Users may have under mandatory applicable law.

5.1 Lawfulness
Personal Data is processed only where there is a lawful basis or other valid justification under applicable law.
5.2 Fairness
The Company aims to process Personal Data in a manner that is fair, transparent, and proportionate to the purposes for which it is collected.

Personal Data is collected and processed only for legitimate purposes relating to the operation, improvement, security, and administration of FanChat, unless otherwise permitted or required by law.

6. WHO THIS POLICY APPLIES TO
This Privacy Policy applies to:
• registered Fans;
• registered Creators;
• verified Creators;
• users purchasing Virtual Coins;
• users receiving promotional benefits;
• users participating in referral programs;
• users contacting customer support;
• individuals participating in KYC or verification processes.
The Policy also applies to former Users to the extent the Company retains information for lawful purposes such as compliance, dispute resolution, fraud prevention, or legal obligations.
7. USER CONSENT
By accessing or using FanChat, you acknowledge and consent to the collection, use, storage, and processing of your Personal Data as described in this Privacy Policy, subject to applicable law.

Verification documents are processed only for legitimate business, security and compliance purposes.
12. PROFILE INFORMATION

• Languages spoken
• Availability status
• Public achievements or badges
• Verification indicators
Certain profile information may be visible to other Users depending on your privacy settings and the features you choose to use.
13. COMMUNICATION DATA
To provide communication services on the Platform, we may process information relating to:

• Audio calls
• Video calls

• Media shared in chats
• Stickers
• Emojis
• Files transmitted through supported features
• Call duration

14. AUDIO AND VIDEO CALL RECORDINGS
To help maintain platform safety, investigate complaints, detect fraud and comply with legal obligations, audio and video calls conducted through FanChat may be recorded.
These recordings may include:
• audio streams;
• video streams;
• timestamps;
• call duration;
• participant identifiers;
• technical metadata.
Call recordings are treated as sensitive information and are protected using appropriate security controls.
Access to such recordings is restricted to authorized personnel and only for legitimate operational, legal, safety or compliance purposes.
15. CHATS, PHOTOS AND MEDIA
FanChat enables Users to exchange:
• text messages;
• photographs;
• videos;
• voice notes;
• documents;
• stickers;
• GIFs;
• other supported digital content.
Content uploaded to the Platform may be stored in encrypted form on secure infrastructure for the period reasonably necessary to:
• deliver the service;
• synchronize across devices;
• investigate abuse;
• comply with legal obligations;
• resolve disputes;
• maintain system integrity;
• support disaster recovery.
Where supported by the Platform, certain chats and associated media may automatically disappear from user view after approximately 24 hours.
The removal of content from user view does not necessarily mean that all copies are immediately erased. Encrypted backups, security logs, legal preservation copies, and disaster recovery copies may continue to be retained for a limited period where reasonably necessary or required by applicable law.
16. WALLET AND PAYMENT INFORMATION
Where you purchase Virtual Coins, subscriptions or other digital services, we may collect:
• Wallet balance
• Transaction history
• Purchased coin packages
• Subscription records
• Gift transactions
• Withdrawal requests
• Payment timestamps
• Refund status

Payments are generally processed through authorized third-party payment service providers.
The Company does not intentionally store complete payment card numbers, CVV numbers, UPI PINs, internet banking passwords or similar payment authentication credentials.

29. AUDIO AND VIDEO CALL RECORDINGS
Audio and video call recordings may be processed for legitimate purposes including:

Access to call recordings is limited to authorized personnel who require such access to perform their duties and is subject to internal controls and audit measures.
The Company does not use call recordings for commercial sale to third parties.

Where ephemeral messaging features are enabled, user-facing content may disappear after the applicable retention period while limited encrypted backup copies may be retained for security, disaster recovery, legal compliance, or fraud prevention purposes for a reasonable period.
31. PERSONALIZATION
We may process certain information to personalize your experience on FanChat, including by:
• suggesting relevant Creators;
• recommending content;
• displaying language preferences;
• improving search results;
• presenting features likely to interest you;
• remembering selected settings.
Personalization is intended to improve usability and does not guarantee that any specific content or Creator will be shown.
32. ANALYTICS AND PRODUCT IMPROVEMENT
Information may be processed to:
• understand how Users interact with the Platform;
• improve user experience;
• identify technical issues;
• measure feature performance;
• optimize application stability;
• improve communication quality;
• evaluate new features;
• develop future services.
Where reasonably practicable, analytics may be conducted using aggregated or de-identified information.
33. CRASH REPORTING AND DIAGNOSTICS

ChatsPub Ventures (OPC) Private Limited does not intentionally store complete payment card numbers, CVV values, UPI PINs, internet banking passwords, or similar payment authentication credentials.
44. LEGAL DISCLOSURES
The Company may disclose Personal Data where reasonably necessary to:
• comply with applicable law;
• comply with judicial orders;
• respond to lawful requests from competent authorities;
• protect the rights, property, or safety of the Company, Users, or the public;
• investigate suspected unlawful activity;

Where permitted by law, disclosures will be limited to information reasonably necessary for the stated purpose.
45. CORPORATE REORGANIZATION
If ChatsPub Ventures (OPC) Private Limited is involved in a merger, acquisition, investment, restructuring, sale of assets, or similar corporate transaction, Personal Data may be transferred as part of that transaction, subject to appropriate safeguards and applicable law.
Where required, Users will be informed of material changes affecting the processing of their Personal Data.

Encryption methods may be updated from time to time to reflect evolving security practices.
The Company reserves the right to adopt new technologies and standards that enhance the confidentiality and integrity of stored information.
48. ACCESS CONTROLS
Access to Personal Data is restricted to authorized personnel who require such access for legitimate business purposes.
The Company maintains internal measures designed to:

Where an ephemeral messaging feature is enabled, chats and associated media may automatically disappear from user view after approximately 24 hours. However, limited encrypted backups, security logs, legal preservation records, and disaster recovery copies may be retained for a reasonable period where necessary for operational continuity, legal compliance, fraud prevention, or the establishment, exercise, or defense of legal claims.
Audio and video call recordings may be retained only for as long as reasonably necessary for the purposes described in this Privacy Policy or as required by applicable law.
When information is no longer required, the Company will seek to securely delete, anonymize, or otherwise render it incapable of identifying an individual, subject to technical feasibility and legal requirements.
50. ACCOUNT DELETION
Users may request deletion of their FanChat account through the methods made available by the Company.
Upon receiving and verifying a deletion request, the Company will take reasonable steps to delete or anonymize Personal Data that is no longer required.
Certain information may continue to be retained where reasonably necessary for:
• legal compliance;
• taxation and accounting;
• fraud prevention;
• security;
• dispute resolution;
• enforcement of legal rights;
• audit obligations.
Deletion of an account does not automatically require immediate removal of all backup copies or records retained under lawful exceptions.

FanChat is not intended for use by children below the minimum age permitted under applicable law.

If the Company becomes aware that Personal Data has been collected in violation of applicable age requirements, reasonable steps may be taken to suspend the account and remove the relevant information where appropriate.
53. INTERNATIONAL DATA TRANSFERS
The Company's primary operations are intended to be managed in accordance with applicable Indian laws.
Where Personal Data is processed or stored outside India, the Company will seek to implement reasonable safeguards consistent with applicable legal requirements.
By using the Platform, Users acknowledge that their information may be processed in locations where the Company's service providers operate, subject to appropriate contractual, technical, and organizational safeguards.

If the Company becomes aware of a security incident affecting Personal Data, it will take reasonable steps to:
